Areas of Interest: Signature and Digital Certification


On this page one can access information about different countries in the region that are using new technologies in support of Signature and Digital Certification. We currently have available materials regarding how the solutions are applied in the following countries: 

Argentina 

For Argentinean legislation, the terms “Digital Signature” and “Electronic Signature” do not possess the same meaning. The radical difference in the approbatory value attributed to each one of them, given that in the case of the “Digital Signature” a presumption "iuris tantum" exists in its favor; this means that if a digitally signed document is correctly verified, it is presumed as a safe test as opposed to what comes from the subscriber of the certified associate and that was not modified. On the contrary, in the case of the electronic signature, the signature is not being recognized for its corresponding title of the person seeking to authorize its validity. Digital Signature: The bulletin of the National Electronic Government Plan of Argentina, reports in its first issue about the resolution 105/2006 of the Attorney General of the Nation. The regulation approves the notification procedure with electronic signature for the resolutions of the Attorney General of the Nation to the fifteen General Offices of the public prosecutor before the Chambers of Internal Appeal of the country, and to the ruling Magistrates and organization area managers, approving a term of 90 days for the accomplishment of the first pilot. Chile 

Use of the electronic signature in Public Administration: See the Implementation Alternatives of Simple Electronic Signatures, their considerations in the future and more. Report presented by Marco Antonio Zúñiga in the French-Chilean Seminar on Electronic Government. Chile-France 2002. 

They test the legal validity for the electronic documents. The Economic Commission unanymously approved the idea to legislate, approved, in the second proceeding, on the initiative that establishes the procedures so that tribunals know the means of approval in the case of misuse of these types of documents.  Costa Rica

They approved the suitability of using digital signature on the Internet. In Costa Rica, an agreement of co-operation was ratified between the Central Bank and the Ministry of Science and Technology, which from 2007 will allow Costa Ricans to be able to use the digital signature to guarantee transmission made on the Internet.  México 

Mexico is broadcasting their Advanced Electronic Signature system through this information: “Now it is possible “to sign” from a computer. With the arrival of the Advanced Electronic Signature, you will be able to carry out different transmissions before the SAT (Tribunal Administration Service) without having to visit our office, using any computer that has Internet access. This signature not only identifies it as the author of the said transmission, but it will also conceal and automatically codify its contents so that no one can read it.” For more information, click here 


 República Dominicana 

The First Technology Platform of Digital Signature Services AVANSI , C. por A, is the high technology Spanish company that will be putting into operation, the first technological platform providing digital signature services in the Dominican Republic. This platform will guarantee the signing of contracts with legal validity, across the network, in a secure and trustworthy environment among interested parties. For more information, click here

The technological revolution of the end of the last century, especially in the electronic and digital field, brought with it a great change in the form of communication, of information transmission, of work and in general, has affected all human activities.
